    • 인류는 산업혁명을 계기로 기술혁신을 본격화하며, 전례 없는 경제 번영과 삶의 긍정적인 변화를 경험하였다. 하지만, 기술혁신 과정에서 사회적 문제도 발생한것이 사실이며, 정부가 혁신의 부작용 해소를 위한 다양한 제도를 마련하는 과정에서 사회혁신도 함께 이뤄졌다. 현재 진행 중인 제4차 산업혁명 역시 긍정적 효과가 클 것으로 예상되지만 부(富)의 쏠림, 데이터·알고리즘의 오남용에 의한 사회적 혼란, 테크 기업의 독점화에 따른 시장경제질서 훼손 등이 예상된다. 이번 보고서를 통해 제4차 산업혁명을 이끄는 테크 기업의 비즈니스 모델별 반경쟁·불공정 사례를 파악하고 유형화하여 정책 과제를 도출하였다.
    • 테크 기업의 비즈니스 모델은 크게 네 종류로 구분할 수 있다. △거래 수수료 모델은 온라인장터를 개설한 후 판매자와 구매자가 거래할 때마다 수수료를 부과하여 수익을 창출한다. △광고 모델은 이용자에게 콘텐츠 등의 무료 서비스를 제공하고 그 대가로 수집한 이용자 정보를 광고주에게 판매하여 수익을 창출한다. △보완재 판매 모델은 독점력을 가진 플랫폼을 무료 제공하고 플랫폼과 보완관계인 기기, 소프트웨어, 콘텐츠 등을 판매한다. △구독 모델은 회원 가입자에게 서비스를 제공하고 이용 기간 동안 정기적으로 비용을 부과한다.
    • 비즈니스 모델에 따라 각기 상이한 반경쟁·불공정 행위가 발생한다. 특히, 구독 모델을 제외한 세 종류의 비즈니스 모델에서 발생하는 반경쟁·불공정행위를 다음과 같이 세 유형으로 구분할 수 있다.
    • 첫째, 길목 지키기(Gatekeeping)는 사업을 위해 반드시 거쳐야 하는 길목을 점유하고 과도한 통행료를 부과하거나 부당하게 통행을 제한하는 행위이다. 수수료 매출을 높이기 위해 거래 상대방에게 불공정한 계약(최혜 대우 요구, 불공정 대가 산정, 재판매 가격 유지, 거래 제한 등)을 강요하는 행위 등 주로 거래수수료 모델에서 발생한다.
    • 둘째, 정보 남용하기(Information Exploiting)는 이용자 정보를 과도하게 수집·남용하거나 이용자에게 제공하는 정보를 왜곡하는 행위이다. 개인화된 광고를 제공하여 광고 단가를 높이거나(과도한 정보 수집) 트래픽 발생을 유도(의도적 품질 저하)하는 등 주로 광고 모델에서 발생한다.
    • 셋째, 독점력 확장하기(Leveraging)는 특정 시장의 지배력을 활용하여 다른 시장의 지배력을 부당하게 취득하는 행위이다. 독점 플랫폼과 보완재를 함께 판매하거나(끼워 팔기) 콘텐츠의 생산과 유통과정에서 인접 단계에 있는 회사를 인수합병하고 경쟁 사업자의 시장 진출을 봉쇄하는(수직 결합) 등 주로 보완재 판매 모델에서 발생한다.
    • 테크 기업의 반경쟁·불공정 사례를 통해 몇 가지 정책 과제를 도출하였다. 우선 경쟁법 집행을 위해 시장지배력 측정 도구로 제조업 중심의 산업화 시대에 사용했던 가격과 수량을 대체하는 기준을 마련해야 한다. 또한 데이터와 알고리즘의 조작에서 많은 문제가 비롯되기 때문에 알고리즘을 감사(Auditing)하거나 알고리즘의 공정성을 감시(Monitoring)하는 시스템 구축 등 제도적·기술적 장치 마련이 필요하다. 끝으로 과도한 정보수집과 남용을 예방하기 위해 시장 지배적 사업자에게 데이터 보호 및 이전 의무를 강화하여 소비자의 정보주권을 강화해야 한다.

    • Human has experienced unprecedented economic prosperity and positive change of life through the industrial revolution of the 19th century. However, it is true that various social problems have arisen in the process of technological innovation, and social system has been improved by preparing various systems for the government to solve the side effects of innovation. The fourth industrial revolution, which is currently underway, is expected to have a positive effect, but may lead to wealth polarization, societal turmoil caused by data and algorithms, and deterioration of the market economy due to the monopolization of tech companies. In this report, we have identified the anti-competitive and unfair behaviors of the tech companies that led the 4th Industrial Revolution.
    • The business models of tech companies can be divided into four types. First, the transaction fee model creates a profit by imposing a commission each time a seller and a buyer trade in the online marketplace. Second, the advertising model provides free services such as contents to users and generates revenue by selling collected user information to advertisers in return. Third, the complementary sales model provides a free platform with a monopoly power, and sells complements of platforms such as devices, software, and content. Fourth, the subscription model provides services to members and charges them periodically during the period of use.
    • Different anti-competitive and unfair practices occur depending on the business model. The transaction fee model either raises price to increase commission revenue or imposes unfair contracts (most favored clauses, unfair revenue share, and resale price maintenance) on the business partners. The advertising model excludes competing advertising platforms (exclusive contracts), raises advertising effectiveness (collects excessive user information), and induces traffic (intentional quality degradation) in order to increase advertising revenue. The complements sales model sells complements along with the monopolized platform(tying) and interferes with a competitor’s business unfairly(competitor discrimination).
    • There are three types of anti-competitive practices of tech companies. First, it is a gatekeeping act that occupies the road that must be passed for the business, imposes excessive tolls, or illegally prohibits pass. This occurs mainly in the transaction fee model. Second, information exploiting means collecting and abusing user information or distorting information provided to users. It occurs mainly in the advertising model. Third, leveraging is behaviors that expanding market power in a particular market toward other markets. It occurs mainly in a complements sales model.
    • Some policy issues have been derived from anti-competitive practices of tech companies. In order to enforce competition law, it is necessary to establish criteria to replace the price and quantity used in the manufacturing industries as a market power measurement tool. Also, since many problems arise from manipulation of data and algorithms, technical and institutional arrangements such as auditing algorithms or monitoring the fairness of algorithms are necessary. Finally, to prevent excessive information gathering and abuse, market-dominant companies should strengthen their data sovereignty by strengthening data protection and data transfer obligations.
