    • 또한 EU가 제시한 것과 같이 고용 관련 제도의 타당성을 평가하거나 적용 지침을 정립할 때 주문형 경제의 긍정적 측면에 보다 주목할 필요 있음
    • 긱 이코노미 종사자들도 다양한 플랫폼을 동시에 활용해 최대한의 이익을 추구하는 플랫폼 사용자의 측면을 가지고 있어 공급자를 확보하기 위한 플랫폼 기업들의 노력과 경쟁도 계속되고 있음
    • 또한 플랫폼 기업들도 보다 나은 서비스 제공을 위해 계약직 또는 정규직 채용을 시도하는 등 시장의 자생적인 변화가 시작되고 있음

    • After many initial dotcom companies suffered from dotcom bubble because of the reasonable doubt of their bussiness models and the profit potentials, new startups have emerged with providing new services based on internet, smartphone and location determination technology in mid-2000s.
    • For these companies, there are so many keywords like Sharing economy meaning ‘sharing unused assets’, O2O service focusing on online companies going into offline services, On-Demand economy providing products and services immediately on a customer’s request, online platform economy consisting of labor platform and asset platform.
    • Recently, companies pursued profits more positively than before and O2O service startups emphasized promptness and convenience, then On-Demand economy seems to be more suitable keyword than sharing economy.
    • Some on-demand economy companies are currently facing classical legal disputes of ‘Misclassification of Employees as Independent Contractors’steming from the increased employment flexibility and alternative work starting at 1970s.
    • Gig economy originated from the daily contract between jazz clubs and jazz musicians in 1920s is another heart of startups being proud of new services for customers.
    • - Many alternative works had emerged by the cost saving strategies of corporations striving against 1970~80’s depressions and kept increasing again after 2007-08 economic crisis, although 1990s economic boom temporarily decreased alternative work proportion.
    • - There is another viewpoint about ‘gig economy’ sprread that young generation prefers to escape from the constraints of conservative full-time jobs and the freedom from the suppressive hierarchical organization.
    • The cause of these legal disputes may be that on-demand startups as intermediaries of two-sided market should perform a few mediation policies for the platform competence and high customer satisfaction.
    • - While customers liked on-demand startups’ services because they provided low transaction cost by location based internet search and the solution of information asymmetry problem by cross-evaluation between customers and providers, they treated many providers as independent contractors or self-employeds to prepare for demand fluctuation and cost-cutting.
    • - A critic research shows that platform company can control a chosen provider’s entire work procedure by algorithm management and make information asymmetry problem worse if the company has the right to set price and use the result of cross-evaluation and other data as the criteria to ban the provider from the platform. Uber is the typical example.
    • There have been many litigations about ‘Misclassification of Employees as Independent Contractors’ and Uber class actions are worthy of notice. In Korea, a similar case is being investigated by the Supreme Court.
    • To protect gig economy workers, there are three approaches. One is to extend the legal definition and coverage of traditional ‘employee’ and the other is that Fair Trade Act is enough because gig workers are self-employed in nature. Third is new special act for gig economy workers.
    • In Korea, non-standard contracted employee means a worker having the attributes of standard employee and self-employed together and Industrial Accident Compensation Insurance Act covers a few non-standard contracted employee categories explicitly specified by presidential decree.
    • To harmonize the innovation of on-demand economy and the protection of gig economy worker, the followings should be considered.
    • It is difficult to extend the legal definition of employee because the categories of non-standard contracted employee are being increased and the employee degree of each category are different. So the protection degree should be differentiated by each category’s characteristics.
    • The legal decision can be influenced by the characteristics of the service provided by an on-demand startup and the terms of service that an on-demand startup applies to providers.
    • When assessing the adequacy of employment rules or providing guidance on the applicability of those, it is required to consider the light side of on-demand economy, following EU’s collaborative economy agenda.
    • Because gig economy workers are also platform users to pursue the high income or profits by multi-homing on various platforms, platform companies are trying to aggregate many providers competitively.
    • Natural and desirable change is observed that on-demand startups try to hire part-time or full-time employee for better service quality.
