      둘째, 가격평가에 있어, 저가입찰경쟁을 방지하고, 기술경쟁력을 향상시키기 위해 행정자치부는 ‘14년 최저입찰가격기준을 예정가격의 60%에서 80%로 상향조정하였는데, 최저입찰가격 미만 입찰시 부여하는 가격평가점수도 배점한도의 60%에서 80%로 함께 상향 조정하여 예정가격의 80% 수준에 맞추기 위한 전략적 저가 입찰에 의한 가격경쟁이 발생할 수 있다.
      마지막으로, 종합점수가 동점인 경우, 협상순위결정을 추첨으로 하는데, 이는 자칫 배점이 높은 중요한 기술요소에 대해 평가를 결여할 수 있다는 우려가 존재한다. 지방자치단체의 재정부담의 측면에서 가격적인 요소를 고려하는 것도 중요하지만 SW개발 사업에 있어서 기술능력을 중심으로 낙찰자를 선정하여 적정 품질을 확보하는 것이 유지·보수, 재개발비용을 줄이고 양질의 서비스를 제공할 수 있어 지방재정과 행정에도 큰 도움이 될 것이다. 따라서 이 보고서 에서는 지방 공공SW의 낙찰자 선정이 기술능력 평가가 중심이 되고, 기업 간 가격 경쟁도 방지하는 방향으로 개선되어야 한다는 결론을 제시하고자 한다.

    • Public SW, excluding SW used internally by conglomerates and their subsidiaries, holds a 40% (2 trillion Korean won in 2016) share of the total SW market; thus occupying a very important position. In public SW development projects today, the winning bid is chosen on the basis of the price and technical capabilities, with the bidder’s technical capabilities (technical capability: price = 9:1) as the main focus. An agreement is then signed with the bid winner after negotiations. In the case of SW development projects in provincial regions, however, there is risk of the technical capabilities of the participating vendors being insufficiently evaluated and too much consideration being given to the bid prices. The following reasons are cited in relation to this concern:
      First, in the process of selecting candidates for negotiations, participating vendors whose bid prices are higher than the estimated price are excluded from negotiations regardless of their technical capabilities and their scores. In this situation, a selection process based on an evaluation of the bid price and technical capability becomes irrelevant. A specific price level becomes the determining factor in deciding whether a vendor is a suitable candidate for negotiations. Second, to promote competition based on technical merits and prevent low price bidding, the Ministry of Interior raised the minimum bidding price from 60% of the estimated price to 80% in 2014. Note, however, that the ministry also raised the bid price evaluation scores given to submitted bids with prices below the minimum bid price. The ministry raised this score from 60% to 80% of the maximum allowed score. This could result in vendors competing to bid low strategically so that they could achieve 80% of the estimated price. Finally, when the total scores are the same, vendors that are up for negotiations are decided through lottery. However, this runs the risk of omitting evaluations on important technical elements that carry a lot of weight in the scoring.
      Price considerations could be important for regional autonomous governments for economic reasons; in SW development projects, however, project vendors must be selected on the basis of their technical capabilities to ensure that proper quality levels are met. Better SW quality leads to lower maintenance, less repair, and reduced redevelopment costs and enables providing high-quality service, ultimately benefitting local finance and local administration. This report concludes that the selection of vendors for regional public SW projects must be based on technical capability evaluations and must be altered in a direction that prevents price competition between bidders.
