SW하도급 노동환경 분석과 개발자 처우 개선방안 연구

    • SW산업과 관련해서 다수의 선행 연구결과물들이 위와 같은 문제점들을 지적하고 있다. 주로 정부부처 산하의 연구기관들에서 연구를 진행하였는데, 주무 정부부처의 관점에 따라 SW산업의 인력 문제를 다루고 있는 점이 이색적이다. 그래서 SW산업 전반에서 발생하는 중층적 다단계 하도급 구조에 대한 분석이 다소 부족하다. 또한, 중층적 다단계 하도급 구조와 관련해서 국외 법제도 사례에 대한 조사를 담당한 선행 연구결과물은 비교적 오래전 자료여서 최근의 내용이 보완될 필요가 있었다.
    • SW산업의 구조적 문제를 해결하기 위해서 SW산업의 ‘일하는 방식’의 특성을 검토해보았다. SW산업은 기본적으로 1차, 2차, 3차 산업의 요소를 모두 갖추고 있지만 인력 투입이 반드시 필요하므로 1차 산업 특성의 요소가 강하다. 또한, 완성물 납품이라는 도급계약이 유리한 생산방식의 특성과 시장이 계속적으로 성장하는 발전적 특성을 지니고 있다. 마지막으로 산업에서 기업과 근로자의 이해당사자 구도가 형성되지 못하는 특성을 지니고 있었다. 결국 SW산업은 기존의 제조업, 건설업과는 다른 특성을 지니고 있다.
    • 국내 SW산업의 기본적인 틀은 수직적인 다단계 하도급 구조이다. 원사업자와 하수급인, 재하수급인으로 이어지는 관계가 다단계 하도급 구조에서 큰 축을 이룬다. 더불어 다단계 하도급 구조에서 직업소개업, 인력파견업 등이 산업 내에 난립하면서 거미줄 구조가 형성되었다. 중층적 다단계 하도급 구조에서 하위 단계에 위치한 종사자들은 임금 향상을 위해서 사용자와 이면계약을 취하는 편법 행위를 하고 있다.
    • 이러한 중층적 다단계 하도급 구조는 다음과 같은 문제를 야기한다. ① 다단계 구조의 하위단계에 위치한 중소기업들은 전문성을 기를 여력이 없어 산업에서 도태될 위험이 있다. 중소기업들은 기업 경영을 위해 전문인력을 고용하기 보다는 일시적으로 파견 등으로 인력을 활용하므로 전문성을 기르지 못하는 악순환에 빠질 수 있다. ② 하위단계 중소기업의 일자리 처우는 매우 열악한 상황에 놓여있다. 다단계를 거치면서 발생하는 할인율로 인해 최초 사업비 대비 하위단계 기업이 취하는 사업비는 낮은 수준이므로 하위단계의 기업의 일자리는 임금 등 처우 측면에서 낮은 수준이기 때문이다. ③ 인력을 상시 고용하는 것보다는 인력을 일시적으로 활용하는 것이 수익성 측면에서 유리하기 때문에 하위 단계 중소기업 사이에서 인력을 파견하는 불법파견이 일어나고 있다. 중소 SW기업의 사용자들은 이와 같은 불법성을 인지하지 못하고 있다. ④ 다단계 구조로 인해 불공정한 계약관계에 놓이게 된다. 하위단계의 중소기업은 사업을 수주하기 위해서 불공정한 계약에도 응하여야만 하는 상황에 놓이기 때문이다.
    • SW산업의 종사자 처우 개선을 위해서 영국, 프랑스, 일본의 사례를 살펴보았다.
    • 영국은 종사자를 3단 분류하는 방법을 취하고 있었다. 근로자, 노동자, 독립계약 3단분류 체계로 원칙적으로 근로자는 노동관계법령에 의해서 보호를 받는다. 노동자는 노동관계법령의 일부만 적용되는 방식이다. 영국 통계청에 의하면 SW개발지 규모는 33만8천명으로 집계되며, IT 관련 노동조합의 조직율은 9.5% 조사되었다. 영국은 직업소개업이 발달해있으며, SW산업의 종사자들도 직업소개업을 통해 구직활동을 하는 것으로 알려져 있다. 영국의 직업알선업체는 정부의 관리감독을 받으며, 노동부가 아닌 산업 담당 정부기관에서 직업소개업자의 불법행위를 단속하는 점이 특색이 있다. 영국은 도제시스템을 운영하여 체계적으로 기술인력을 양성하는 방식을 취하고 있다. 정부는 SW산업에도 도제시스템을 운영하고 초급 교육과정에서부터 고급 교육과정까지 체계적으로 관리한다. 그리고 정부는 고급 교육과정을 거친 훈련자에게 학위 등의 자격을 인정하는 절차를 통해서 경력관리를 지원하고 있다. 영국의 하도급관계는 하도급법과 같은 특별법이 있는 것이 아니라 계약과 관련된 일반법에 의해 규율된다. 국내와 같이 다단계 하도급 거래관계에 대한 사례는 찾을 수 없었다. 제3자(하수급인)의 권리를 인정하는 계약을 체결한 경우 원도급인으로부터 대가를 청구할 수 있는 채권이 인정된다.
    • 프랑스의 경우 산업 종사자를 2단계로 분류하며, 근로자로 인정 여부는 판례에 따른다. 국내의 SW프리랜서는 사용자의 법률적 종속성이 강하기 때문에 프랑스법에 의하면 근로자로 인정될 것으로 판단된다. 국내에서 특수형태고용종사자와 유사하게 노동법의 일부를 적용받는 독립계약자가 존재하나, SW프리랜서는 이에 해당할 여지가 없어 보인다. 프랑스에서 SW개발자에 대한 통계는 조사할 수 없었으나, 특정 주의 통계에서 개발자의 규모가 성장하는 것을 알 수 있었다. 프랑스는 직업소개업을 공공에 의해서 관리하며, 인력파견업은 특별법이 아닌 노동법의 일부 조문으로 규제하고 있다. 2016년 개인활동계좌제도(CPA)를 도입하면서 전 산업에서의 비정규직까지 사회안전망을 넓히고 있다. 프랑스 노동법에 SW개발자의 경우 근로자로 인정받더라도, 프로젝트 단위로 계약을 체결하는 기간의 정함이 있는 근로자로서 비정규직일 가능성이 높다. 따라서 이와같은 개인활동계좌제도는 SW프리랜서의 처우 향상에 도움을 주고 있다. 이외에 프랑스는 불공정경쟁법, 하도급에 관한 법률로 하도급 관계에서 불공정행위를 규율하고 있고, 사회연대책임법을 통해 근로자들의 교섭력을 향상시키는 방향을 취하고 있는 점은 주목할 필요가 있다.
    • 일본은 기본적으로 국내와 유사한 산업환경이 조성되어있다. 노동법제의 편제도 유사하여 산업의 종사자를 근로자와 독립계약자로 나누고 있다. 일본의 정보처리추진기구의 “2019년 IT인재백서”에 따르면, 2018년도 IT인력의 총 수는, 총 1,226,000명 규모로 조사되었다. 2018년 기준 정보통신업의 노조조직률(추정) 17.2%해당하며 산업별 노조에 가입된 것으로 알려져 있다(일본은 일반적으로 기업별 노조의 형태이다.) 최근 일본 정부는‘일하는 방식 개혁’ 정책을 발표하였고, 전 산업 노동환경 개선을 통해서 생산성을 제고하고자 한다. 일본에는 전문적인 직업알선업체가 있으며, 최근 법개정을 통해 직업소개 수수료율을 공개하고 있다. SW산업은 인력파견 기간 제한 규정 적용 제외 업종이었으나, 최근 법 개정에서 기간 3년 이내의 인력파견이 가능한 업종으로 전환되었다. 일본은 현재 다양한 방식으로 기금을 조성하여 직업훈련 교육을 실시하고 있다. 국내와 같이 독점의 금지 및 공정 거래의 확보에 관한 법률(국내 공정거래법과 유사)과 하청 대금 지급 지연 등 방지법(국내 하도급법과 유사)와 제정되어 있어 하도급을 규율하고 있다. 국내 SW산업진흥법과 같은 산업 측면에서 하도급을 제한하는 명문의 규정은 없다.
    • SW산업에서 다단계 하도급 문제를 해결하기 위해서 ①우선 산업 전반에 다단계 하도급에 대한 인식 개선과 ② 현재의 하도급 관련 법·제도의 효율적인 집행을 위한 정비가 필요하고, ③ 장기적으로 하도급 인력을 통해 개발하는 것보다 발주자, 원청에서 직접 인력을 채용하여 개발하는 방식을 취하도록 유도책을 모색해보아야 한다. 다음으로 산업 전반의 음성적인 인력파견을 개선하기 위해서는 ① 직업소개업에 대한 국제의 통제권을 높이고, ② 무허가 인력파견업체의 양성화 및 무허가 위반에 대한 엄중 처벌을 강화하는 방안이 필요하다. 마지막으로 SW산업의 종사자에 대해 새로운 방식으로 접근하기 위해서는 ① 제조업 기반 기술습득 방식의 직업훈련을 새롭게 전환하며 ② 고용시장에서 노동 유연성 확보하고 ③ SW산업의 집단적 교섭력 향상 방안에 대해서 정부, 기업, 노동자의 합의를 이루를 절차를 마련할 필요가 있다. 나아가, SW업계의 프리랜서에 대한 법적 정의를 두어 앞으로의 산업 발전을 대비하고, 앞에서 살펴본 바와 같이 SW산업 종사자의 집단적 교섭 창구를 마련하는 방안에 대해 추가 연구가 필요할 것으로 생각한다.
  • SUMMARY
    • As the SW industry continues to develop, the demand for industrial workers such as SW development is increasing. The government is implementing various support policies to attract SW workers to the industry, and corporations are making efforts to introduce incentives. However, workers have a negative view of the working environment of the SW industry, and in fact, it is possible to diagnose that there is a problem in the job market due to the fact that workers who have entered the industry have defected to other industries.
    • Many previous studies in the SW industry point to the above problems. The research institutions under the government departments conducted the research and the details of the research dealt with the problem of SW industry according to the view of the relevant government departments. Therefore, there is a lack of analysis on the hierarchical multi-level subcontract structure that occurs throughout the SW industry. In addition, since the previous research results that investigated the case of foreign legal system related to the multi-tiered sub-level subcontract structure are relatively old data, the recent contents need to be supplemented.
    • In order to solve the structural problems of the SW industry, the characteristics of the “working method” of the SW industry were examined. SW industry basically has elements of both primary, secondary and tertiary industries, but since manpower input is essential, the element of primary industry characteristics is strong. In addition, the contract of the delivery of finished goods has the characteristics of favorable production method and development characteristics that the market continues to grow. Lastly, there was a lack of formation of stakeholder structures of companies and workers in the industry. After all, the SW industry has different characteristics from the existing manufacturing and construction industries.
    • The basic framework of the domestic SW industry is a vertical multilevel subcontracting structure. The relationship between the original business owners, subcontractors, and subcontractors forms a large axis in the multistage subcontract structure. In addition, the web structure was formed as job introduction and manpower dispatch were rampant in the industry in a multi-level subcontracting structure. Workers at the lower levels of the multi-tiered subcontracting structure are acting as shortcuts to write back contracts with employers to improve wages.
    • Multilevel subcontracting structures raise the following problems. ① Small and medium-sized enterprises(SMEs) located in the lower stages cannot afford to develop expertise and risk being left out of the industry. As SMEs use their manpower temporarily through dispatch rather than hiring professional workers, their expertise could gradually deteriorate. ② Job quality of low-level SMEs is in a very poor situation. Due to the discount rate that goes through multiple stages, the cost of lower-level SMEs is lower than the total cost of the original business owners, so the jobs quality of lower-level SMEs are low in terms of treatment such as wages. The illegal dispatch of workers is taking place among lower-level SMEs , as it is advantageous in terms of profitability to temporarily utilize the manpower rather than regular employment. The presidents of small and medium-sized software companies are not aware of this illegality. ④ The multi-level structure leads to an unfair contractual relationship. This is because low-level SMEs have to accept unfair contracts in order to win business.
    • In order to improve the treatment of workers in the SW industry, the cases of the UK, France and Japan were examined.
    • UK was taking a three-tier approach to classifying industrial workers. In principle, an employees are protected by labor laws under a three-tier system of Employees, Workers and Independent contractors. Workers are a way of applying only part of the labor laws. According to the U.K. National Statistical Office (NSO), the SW development site was tallied at 338,000 people, and the IT-related labor union's organization rate was 9.5 percent. The UK has a well-developed job opening, and SW industry workers are also known to seek a jobs through job placement services. British job placement agencies are supervised by the government, and they are characterized by the crackdown on illegal activities by job seekers at government agencies in charge of industry, not the Ministry of Labor. The UK has a systematic way of training technical personnel by operating an apprenticeship system. The government also operates an apprenticeship system in the SW industry and systematically manages high-end education courses from elementary to high-quality ones. And the government supports career management through the process of granting degrees and other qualifications to trainees who have undergone advanced curricula. Subcontracting relationships in the UK are regulated by general laws relating to contracts, not by special laws such as subcontracting. No cases of multi-level subcontracting were found, such as in Korea. If a contract is signed to recognize the rights of a third party (subcontractor), a bond that can be claimed by the original contractor shall be granted.
    • In the case of France, industrial workers are classified into two levels, and whether they are recognized as workers or not is according to the precedent. Due to the strong legal dependency of users, SW freelancers in Korea are deemed to be workers under French law. There are independent contractors who are subject to part of the labor law, similar to special type employment workers in Korea, but SW freelancers do not seem to be the case. Statistics for the entire SW developer in France were not found, but statistics for a particular region showed that SW developers were growing. France controls job placement agencies by the public, while labor dispatch companies regulate them by some clause of the labor law, not by special law. The introduction of the personal activity account system in 2016, expanding the social safety net to non-regular workers in all industries. Even if SW developers are recognized as workers in French labor law, they are likely to be non-regular workers as well as workers who have a stipulation on the period of signing contracts on a project-by-project basis. Therefore, the personal activity account system helps improve the treatment of SW freelancers. In addition, it is worth noting that France regulates unfair practices in subcontract relations with the Act on Unfair Competition and Subcontracting, and that it is taking steps to improve workers' bargaining power through the Social Solidarity Liability Act.
    • Japan has a basic domestic industrial environment. The drafting of the labor legislation is similar, dividing industrial workers into workers and independent contractors. According to the "2019 IT Human Resources white paper" by Japan's Information Processing Promotion Agency, the total number of IT personnel for 2018 was 1,226,000 in total. As of 2018, 17.2 percent of the information and communication industry's union organization rate (estimated) was accepted and is known to have joined the industrial union (Japan is generally a form of corporate union).
    • In order to solve the problem of multi-level subcontracting in SW industries, it is necessary to improve awareness of multi-level subcontracting throughout the first-tier industry. And The current subcontract-related laws and systems need to be readjusted for efficient execution. In addition, rather than developing through sub-contractors in the long run, measures should be sought to induce owners to hire and develop employees directly from the original office. Next, in order to improve the negative workforce dispatch across the industry, the international community will have greater control. And Measures are needed to induce unauthorized manpower dispatch companies to obtain permission and to strengthen stern punishment for unauthorized violations. Finally, in order to approach SW industry workers in a new way, job training in manufacturing-based technology acquisition methods should be transformed. And labor flexibility should be secured in the job market. In addition, it is necessary to prepare procedures for achieving the consensus of the government, businesses and workers on ways to improve collective bargaining power in the SW industry. Furthermore, we should prepare for future industrial developments by having legal definitions of the freelancers of the SW industry, and prepare for a collective bargaining channel for SW industry workers as we have seen earlier.
